Terms and Conditions (B2B)

B2B Notice: We sell exclusively to business customers (B2B). No right of withdrawal applies.

1. Scope

These Terms and Conditions apply exclusively to business customers. By placing an order, the customer confirms that they act as a business (entrepreneur) and not as a consumer.

3. Offers and conclusion of contract

Our offers are non-binding and subject to change. A contract is concluded when we confirm the order in writing (e.g. by email) or dispatch the goods.

4. Prices and payment

Unless stated otherwise, all prices are net prices and exclude statutory VAT. Payment is due immediately without deduction, unless otherwise agreed in writing. We reserve the right to request advance payment for certain orders.

5. Delivery and delivery time

Delivery times are non-binding unless expressly agreed otherwise. Partial deliveries are permissible insofar as reasonable for the customer. In the event of force majeure or unforeseeable events beyond our control, delivery periods may be extended.

6. Transfer of risk

The risk passes to the customer as soon as the goods are handed over to the carrier, freight forwarder or shipping service.

7. Retention of title

The goods remain our property until full payment of all claims arising from the business relationship.

8. Inspection of goods and warranty

The customer must inspect the delivered goods immediately upon receipt and notify us in writing without undue delay of any obvious defects. Warranty claims are limited to the statutory scope; in B2B transactions, claims for damages due to defects are excluded to the extent permitted by law.

9. Liability

We are liable only for intent and gross negligence. Liability for slight negligence is excluded, except in cases of personal injury. Liability for indirect damages, consequential damages, loss of profit or data loss is excluded to the extent permitted by law.

10. Returns

Returns are only possible after prior written agreement. Custom-made, personalized or specially ordered goods are excluded from return. The customer bears the costs and risk of return shipment unless otherwise agreed.

11. Data protection

Personal data is processed in accordance with our Privacy Policy and applicable data protection laws.

12. Governing law and jurisdiction

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Place of jurisdiction is the competent court at the registered office of Kartshop Eichinger, unless mandatory law provides otherwise.

13. Final provisions

Should any provision of these Terms and Conditions be invalid or unenforceable, the validity of the remaining provisions shall not be affected. Amendments or supplements must be made in writing to be effective.
